It is the sole discretion of RLH about how, under what terms and with whom RLH may from time to time elect to invest (and as to any commissions or compensation that may be paid or payable to any party by virtue of RLH’s election to so invest). Any decision as to whether RLH may invest, and the terms upon which RLH may invest (including with respect to any related commissions or compensation), will in all cases be subject to negotiation, execution and delivery of definitive investment documents by RLH with respect to the investment.
